Complaint for Declaratory and Injuctive Relief for the Gunnison's Prairie Dog

A coalition of scientists, spiritual leaders, and conservation groups filed this Complaint in federal court because of the Fish and Wildlife Service's (Service) refusal to conduct a full review over whether to list the Gunnison's prairie dog under the ESA

The United States Fish and Wildlife Service’s negative 90-day finding violated the Endangered Species Act by: failing to base its decision on the best available science; failing to draw causal connections between loss of populations and habitat due to plague with overall declines in the species’ population; failing to fully consider continuing poising/eradication efforts; failing to consider the effect of drought; finding that oil and gas activities and sprawl do not threaten further loss of habitat; improperly relying on promised future management measures; failing to consider whether the species is in danger throughout a significant portion of its range; reviewinginformation beyond the four corners of the Petition; and applying the wrong standard of review.
